In light of his experience as an executive responsible for offshoring and outsourcing, Dave has a particular interest in helping foreign companies that may be new to the U.S., or growing their U.S. workforces, navigate U.S. employment laws and human resources standards.
Workplace Training
Workplace training is an important component of any in-house legal or human resources function. In some jurisdictions, training is a requirement. No matter where your business is, however, training reduces risk and shows your employees that you care about workplace issues. Dave has provided workplace training to all sorts of companies, from young start-ups to Fortune 500, in a way that is informative, fast paced, and entertaining. Trainings are available on subjects ranging from appropriate workplace behaviors to anti-harassment to working in a globally distributed workgroup.
Workplace Investigations
Dave has handled numerous investigations into workplace situations with sensitivity to the workplace culture, privacy, and the complexity of many workplace concerns. Dave handles concerns and complaints related to federal and state Equal Employment Opportunity laws from the investigation phase to the agency's final decision. He has represented clients on EEO matters across the country.
Employment Agreements
Dave has prepared and negotiated countless employment agreements and severance arrangements for a wide variety of employers and employees. Dave will listen to the desired outcome and develop a strategic plan to get there, if possible. At the same time, Dave understands that all outcomes are not possible and therefore refuses to waste a client's money on fruitless efforts. His approach is to be respectful and direct at all times. Dave has found that any other way does a disservice to the process and the client.
Alternative Dispute Resolution ("ADR")
Dave is a firm believer in Alternative Dispute Resolution methods. Dave has handled formal arbitrations and mediations. He has also helped to facilitate informal dispute resolution processes employed by some companies internally. With respect to these informal processes, Dave believes that there is a tendency to discount the benefit of having two parties sit down to air their grievances. There is no question that both employer and employee feel better after their differences have been aired. Employees who feel as if they have been treated fairly tend not to sue. ADRs are an effective tool in reducing risk quickly and inexpensively.
Offshoring and Outsourcing
Dave managed large scale offshoring and outsourcing for a Fortune 200 company as a Director of Information Technologies. He is uniquely suited, therefore, to provide advice and counsel on such matters. Dave is intimately familiar with the challenges that offshoring and outsourcing have on workplace culture and has spoken to large audiences on the subject. Dave has helped appraise offshoring and outsourcing opportunities, developed offshoring and outsourcing methodologies, and dealt with the challenges of managing a global workforce.
